§ 16-25. Hearing authorities for suspension or removal of law enforcement officers.
(a)
The village will follow the procedure under Wis. Stats. § 62.13(5) before suspending, reducing, suspending and reducing, or removing any police chief or other law enforcement officer who is not probationary, and for whom there is no valid and enforceable contract of employment or collective bargaining agreement which provides for a fair review prior to that suspension, reduction, suspension and reduction or removal.
(b)
This section shall not preclude the village from choosing to establish, appoint, or request the following entities to act in place of the board of police and fire commissioners for disciplinary actions taken against any police chief or other law enforcement officer under Wis. Stats. § 62.13(5):
(1)
Establishing a committee of not less than three members, none of whom may be an elected or appointed official of the village or be employed by the village;
(2)
Appointing a person who is not an elected or appointed official of the village and who is not employed by the village; or
(3)
Sending a written request for a hearing examiner to the division of hearings and appeals under Wis. Stats. § 15.103(1). The village shall reimburse the state for the state's costs under this section.
